HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.4778 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.1 to 5 under Section 482 Cr.P.C seeking to quash the proceedings in C.C No.170 of 2015 on the file of XIII Additional Chief Metropolitan Magistrate (Mahila Court), at Hyderabad registered for the offences punishable under Sections 498-A, 406 and 420 IPC and Sections 3 & 4 of D.P Act.

2) Heard learned counsel for the petitioners/ accused Nos.1 to 5 as well as 2nd respondent-de facto complainant. Perused the material on record.

3) It is submitted that the de facto complainant filed a memo to compound the offence and filed a joint memo stating that by virtue of the settlement arrived between the parties on 11.05.2015 by paying an amount of Rs.10,00,000/- through DD bearing No.112000 dated 09.05.2015 drawn on Andhra Bank, MLA Colony Branch, Banjara Hills, Hyderabad and the same was received by the de facto complainant. They further stated there are no other crimes between them to compound the offences in this regard.

4) Accordingly, permission is accorded to compound the offences by invoking Section 482 Cr.P.C to subserve the ends of justice and as the defacto-complainant want to compound the entire case including the proceedings are permitted to be compounded at the crime stage. Accordingly, the offences are compounded in terms of their compromise at the instance of the defacto-complainant since present.

5 ) Accordingly, the Criminal Petition is allowed and all the

proceedings relating to C.C No.170 of 2015 on the file of XIII Additional Metropolitan Magistrate (Mahila Court) at Hyderabad are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.

6) As a sequel, miscellaneous petitions, if any filed in this Criminal Petition, shall stand closed.
