THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6246 of 2018 ORDER:

The petitioners filed this Writ Petition challenging the action of the respondents in not issuing pattadar pass books and title deeds for the subject land situated at Maheswaram Village and Mandal, Ranga Reddy District.

The petitioners submit that the subject land is ancestral land and they have certificate of ownership under Section 38-E of the Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act. They state that they are in possession of the said land and cultivating the same for more than four decades. They applied to the Tahsildar, Maheswaram Mandal, for issuance of pattadar pass books and title deeds and sought for mutation. In spite of repeated requests, when there was no response, they filed the present Writ Petition. This Court noticed that the petitioners did not apply in proper proforma for mutation of their names in the revenue records and in view of the same, liberty is given to the petitioners to apply for mutation of their names in the prescribed proforma under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act. As and when such application is filed, it is needless to observe that the fourth respondent shall pass appropriate orders in accordance with

law after issuing notice to the parties interested in the said property.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 26.02.2018 vs
