HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.1908 of 2022 O R D E R:

This petition is filed under Section 438 of the Code of Criminal Procedure, 1973, seeking pre-arrest bail to petitioner on mere apprehension that he may arrest by the police in an unregistered crime on the file of Mancherial Police Station, Adilabad District. 2.

Learned counsel for petitioner Mr. S. Laxminarayana, submits that without any basis, the police are calling the petitioner to the police Station and threatening to register a complaint against him. 3.

On the other hand, learned Assistant Public Prosecutor submits that a case was registered against the petitioner as Cr.No.56 of 2022 for the offences punishable under Sections 270 and 273 IPC and he is arrayed as A2.

In reply, learned counsel for the petitioner submits that this Court has already quashed several complaints registered for the offences punishable under Sections 270 and 273 IPC and held that the IPC offences are not attracted.

In view of the aforesaid submissions, this Court deems it appropriate to grant pre-arrest bail to the petitioner-accused.

The Criminal Petition is allowed. Petitioner - Accused shall surrender before the Station House Officer, Mancherial Police Station, Adilabad District, in an unregistered crime, within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he shall be released on bail. It is made clear that no further extension of time will be granted.
