Puli Lakshmi, v. State Of Telangana,
Date :09.10.2017 Between :
Kongara narasaiah S/o Sri Yellaiah 65 years R/o Shyampet Haveli village, Geesukonda mandal, Warangal Petitioner And State of Telangana Rep by its Principal Secretary, Revenue, Secretariat, Hyderabad and others Respondents The Court made the following:
COMMON ORDER:
Learned counsel for petitioners contended that petitioners were assigned lands in the respective survey numbers. Pursuant to the assignment granted, they are in possession and enjoyment of the same and the lands were not resumed. According to petitioners, the very same lands are now sought to be requisitioned by the State Government for the purpose of establishing the Textile Park. Having came to know that the Government is in favour of establishing Textile Park, petitioners made representations to pay them ex-gratia for resuming the land and also to provide employment as per the scheme envisaged in the proposed Textile Park plan. Alleging inaction in disposing the said representations and paying the compensation, these writ petitions are filed. 2.
On the contrary, learned Assistant Government Pleader, on instructions, submits that as the assignment conditions are violated long ago by the assignees, the respective extents of the lands were resumed and lands actually vests in the Government, therefore, the claim of the petitioners is not valid.
3.
As the learned counsel for petitioners submitted that representations were made by petitioners praying to pay the ex-gratia and to provide employment in the proposed Textile Park and respondents may be directed to dispose of said representations expeditiously, at this stage, Court is not going into merits of the respective contentions. 4.
In the circumstances, without expressing any opinion on the merits of the matter, the writ petition is disposed of with the following direction.
5.
The Tahsildar/4th respondent is directed to examine the claim of the petitioners vis-à-vis the revenue records including D-Form
Patta Register, if necessary by directing the petitioners to produce the assignment pattas granted to them. If assignment pattas granted to them were not cancelled and the land is not resumed, examine the claim of the petitioners for payment of ex-gratia as well as provision of employment and furnish suitable reply to the petitioners as expeditiously as possible, preferably within 8 weeks from the date of receipt of copy of this order. No costs.
Having regard to the same, miscellaneous petitions, if any pending, are closed.
