HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6233 OF 2018 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
In view of the nature of disposal of the present writ petition, notices to the respondents 4 and 5 are dispensed with and the writ petition is being disposed of at the stage of admission. Even after granting time on 26.02.2018, learned Government Pleader could not get instructions with regard to the pendency of the appeal alleged to have been filed by the petitioner on 10.04.2017.
It is the case of the petitioner that his grandfather acquired the land to an extent of Ac.0.21 guntas in Sy.No.251/A and Acs.2.03 guntas in Sy.No.251/AA situated at Manikonda Jagir Village, Rajendra Nagar Mandal, Ranga Reddy District and he has been in possession of the same till his death on 23.12.2000. Thereafter, the petitioner came into possession of the same. It is further stated that the revenue records were tampered and the name of the 4th respondent was entered against the 'ownership' column and the name of 5th respondent was entered under 'possession' column in respect of the land situated in Sy.No.251/A and the name of 4th respondent was entered in both the columns in respect of the land situated in Sy.No.251/AA. The petitioner further states that he preferred an appeal on 10.04.2017 before the 2nd respondent for correcting the entries in the revenue records and when the same is not disposed of, he filed the present writ petition.
As stated above, the learned Government Pleader could not get instructions with regard to the pendency of appeal. If the appeal preferred by the petitioner on 10.04.2017 is still pending, the 2nd respondent is directed to consider the same and pass appropriate orders thereon within three months from the date of receipt of a copy of this order after issuing notice to the petitioner and respondents 4 and 5.
With the above direction, the Writ Petition is disposed of. No costs.
