HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7288 OF 2017 ORDER:
The case of the petitioners is that they were allotted Plot Nos.205 and 204, respectively, admeasuring 2 cents each in Survey No.260, Situated at Kantheru Village, Tadikonda Mandal, Guntur District, on 25.09.1984 by the 2nd respondent. Since then the petitioners are in continuous possession and enjoyment of the subject land and also constructed houses in the said plots and have been staying in their respective houses. While so, at the instance of 6th respondent the 1st respondent is trying to evict the petitioners from the subject land for laying road, without following due process of law. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioners.
Learned Government Pleader for Revenue submits that under the guise of allotment of plots, petitioners are trying to encroach the road adjoining their plots, as such the respondent authorities prevented the petitioners. He also submits that in so far as the petitioners' lands are concerned, the respondents are not interfering with the same and that if at all the Government requires the land allotted to the petitioners, the respondent authorities will follow due process of law.
In view of the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of directing the respondent authorities not to evict the petitioners from the land admeasuring 2 cents each in Plot Nos.205 and 204 respectively, in Survey No.260, Situated at Kantheru Village, Tadikonda Mandal, Guntur District. However, this will not preclude the respondent authorities from taking steps for stopping the encroachment of road by the petitioners and any third parties. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 03.03.2017 Note: Issue CC in three days.
