Ramasubramanian) The petitioner, who is managing a Convention Hall, has come up with the above writ petition seeking merely a facility of payment of the penalty in instalments.

Heard Mr. G. Manoj Maharaj, learned counsel for the petitioner and Mr. B. Narasimha Sarma, learned special standing counsel for the respondents.

It appears that the petitioner has already paid the service tax component. The amount of penalty is fixed at around Rs.8,86,408/ -. By letter dated 27.03.2019, the petitioner requested the facility of payment by instalments. Thereafter, he has come up with the above writ petition.
In view of the limited nature of the prayer made, the writ petition is disposed of permitting the petitioner to pay the amount of penalty in ten (10) equal monthly instalments. The first instalment shall be paid on or before 10.05.2019. All subsequent instalments shall be paid on or before 10th of every succeeding English calendar month. If the petitioner fails to pay any two consecutive instalments, the facility granted herein shall stand withdrawn. Consequently, pending miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
