HONOURABLE SRI ]USTICE SAN]AY KUMAR CRIMINAL PETITION No.1897 of 2019 ORDER:

The petitioners, accused Nos.1 and 2 in Crime No.21 of 2019 on the file of Edulla Bayyaram Police Station, Bhadradri-Kothagudem Dlstrict, which was registered under Section 306 IPC, seek anticipatory bail under Section 438 Cr.P.c.

Learned Assistant Public Prosecutor, State of Telangana, would inform this Court that 8 witnesses were already examined and the F.S.L. report is awaited. He would further state that if the petitioners/accused Nos.1 and 2 cooperate with the investigation, they may be enlarged on anticipatory bail at this stage subject to conditions.

Given the aforestated facts, this Court is o1' the opinion that this is a fit case for grant of anticipatory bail subject to some conditions being imposed.

The Criminal Petition is accordingly allowed. In the event the petitioners, accused Nos.1 and 2 in Crime No,21 of 2019 on the file of Edulla Bayyaram Police Station, Bhadradri-Kothagudem District, are arrested, they shall be enlarged on bail upon their furnishing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each along with two sureties for a like sum each to the satisfaction of the Station House Officer, Edulla Bayyaram Police Station, Bhadradri-Kothagudem District.
