HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Civil Revision Petition No.686 of 2017 ORDER:

This C.R.P is filed by the petitioner/decree holder aggrieved by the order dated 22.12.2016 in E.P.No.56 of 2016 in O.S.No.296 of 2013 on the file of Principal Junior Civil Judge, Kadapa, whereunder the execution Court has dismissed the Execution Petition filed under Order XXI Rule 32 CPC by the petitioner/decree holder holding that under Order XXI Rule 32 CPC, the execution Court cannot grant police-aid as such method is not contemplated under the said provision.

2) When the matter came up for hearing, learned counsel for petitioner sought permission to withdraw the CRP with a liberty to file fresh execution petition strictly inadherence to the provision under Order XXI Rule 32 CPC.

3) Considering his request, this CRP is dismissed as withdrawn granting liberty to file a fresh execution petition in terms of Order XXI Rule 32 CPC, and if the D.Hr so files, the Court has to dispose of the same on merits.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
