HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.16803 OF 2001 ORDER:

This Writ Petition is filed seeking a direction to respondents to promote the petitioner as Assistant Manager in the available existing vacancy in Visakhapatnam on par with his juniors basing on his seniority and also direct the respondents to protect the seniority of the petitioner from the date of his conversion as Loans Inspector. Heard the parties.

It is brought to the notice of this court that the petitioner was offered promotion as accountant vide proceedings dated 28th November, 2014 and the petitioner has relinquished this promotion and requested to cancel the promotion and the respondents vide proceedings dated 4th December, 2014 has cancelled the promotion orders issued in favour of the petitioner and the individual was retained at Visakhapatnam in the cadre of the Senior Assistant. It was also informed to the court that the petitioner has retired from service on 31st December, 2016 on attaining age of superannuation.

Therefore, no lis in this Writ Petition survives and accordingly, this Writ Petition is dismissed as infructuous. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
