Dr. Nirinala Agarwal v. The Medical Council Of India
Date :16.2.2016 Between :
Dr Nirimala Agarwal R/o 21-1-366/370, Ricab Gunj, Hyderabad Petitioner And The Medical Council of India Rep by its President Dr Jayashree Mehta Pocket 14, Sector-8, Dwaraka New Delhi and others Respondents The Court made the following:
ORAL ORDER:
In the writ petition, petitioner challenges the simultaneous continuation of the disciplinary proceedings by the Medical Council of India as well as A.P. Medical Council. Having found prima facie that such continuation as violating Regulation 8.7 of the Medical Council of India Regulations, this Court granted interim orders by order dated 11th September, 2014. Alleging that the said order of this Court is violated, this Contempt Case is filed.
When the matter is taken up, learned standing counsel as well as learned counsel for petitioner state that the connected W.P. Nos. 7369 and 11355 of 2015 were allowed by order dated 24.4.2015 setting aside the order impugned therein. However, this Court remitted the matter to Medical Council of India for consideration afresh and passing appropriate orders. Aggrieved by the order of this Court to the extent of remanding the matter to the Medical Council of India, petitioner herein filed WA No. 472 of 2015 and in the said appeal, interim order is granted in favour of petitioner.
In view of the subsequent developments, I do not see any reason to continue the contempt proceedings initiated as violating the interim order passed by this Court in WPMP No. 31034 of 2014 in WP No. 24789 of 2014 dated 11.9.2014.
Accordingly, the contempt case is closed. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE:16.2.2016 TVK
