HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17048 OF 2003 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondents in not considering the claim of the petitioner for appointment as conductor/cleaner/shramik/clerk or in any other suitable post under Bread Winner Scheme, and in rejecting her case vide proceedings dated 26.11.2002, as illegal and arbitrary, and consequently, to direct the respondents to appoint the petitioner in any suitable post under the Bread Winner Scheme. 2.

Heard Sri M. Manohar Reddy, learned Counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for the respondent-Corporation.

It has been contended by the petitioner that she is the daughter of late K. Nagisetty, and while her father was working as Painter, Zonal Work Shop, Cuddapah, died on 6.1.2002, and then, she submitted a representation dated 9.11.2002 to the respondents to consider her case on compassionate grounds under Bread Winner Scheme, but the respondents considered and rejected her case vide order dated 26.11.2002 impugned herein. Further, it has been contended that as per the latest schemes introduced by the respondents during 2015

and 2017, she is eligible for appointment on compassionate grounds and therefore, the respondents may be directed to consider her case.

This Court having considered the submissions made by the parties and the material available on record, is of the view that the case of the petitioner deserves to be considered for appointment.

Accordingly, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for appointment in any suitable post, as per her eligibility, on compassionate grounds, in accordance with the schemes, and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.
