HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9023 of 2016 ORDER:

Assailing the action of third respondent in not allowing the petitioner to distribute the essential commodities to the cardholders, the present Writ Petition is filed. It is the case of the petitioner that he has been appointed as Fair Price Shop Dealer for Shop No. 14 of Palleguntha village, Gurazala Mandal, Guntur District. While so, on account of ill health, on the advise of doctors, he took leave on 24.08.2015, which was approved by the respondent authorities. It is his further case that after recovery from the illness, he submitted a representation to the respondent authorities on 09.02.2016 to allow him to discharge duties as Fair Price Shop Dealer. When no orders are passed, the present Writ Petition is

filed.

Considering the fact that the authorization of the petitioner is in force as of today and his representation dated 09.02.2016 is pending consideration, the respondents are directed to consider the said representation and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order. It is also made clear that the petitioner is entitled to seek renewal of his authorization once restoration order is passed in his favour.

Subject to the above, the Writ Petition is disposed of at the admission stage.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
