THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6296 OF 2018 O R D E R :

This Writ Petition is filed to declare the action of Respondents 2 and 3 in issuing notice dated 01.02.2018 inviting bids for the works of Operation and Maintenance of various CPWS Schemes in YSR Kadapa District, including CPWS Scheme for Kamalapuram, Mydukuru and B. Mattam Sub-Divisions, without giving any written assurance to settle bills, as illegal and arbitrary. Vide proceedings, dated 24.03.2017 of the Chief Executive Officer, Zilla Praja Parishad, YSR Kadapa District, the petitioner was entrusted with the work of Operation and Maintenance of CPWS Scheme to Mydukuru and other habitations for the year 2016-17. The main ground on which the petitioner challenges the tender notice dated 01.02.2018 is that with respect to the works executed by him, particularly for supply of water for the year 201617, bills have not been settled. In those circumstances, the petitioner submits that the respondents ought to have continued him for execution of the works.

This Writ Petition came up for admission on 27.02.2018, on which, it was adjourned to 06.03.2018.

So far as the challenge to the tender notice is concerned, as on date, the same has become infructuous, as the last date for submission of bid is 03.03.2018 and that the petitioner has also participated in the tender process. So far as the allegation that the petitioner has not been settled the bills for the works executed by him is concerned, the learned Government Pleader for Panchayat Raj has placed on record the brief note submitted by the respondent Executive Engineer RWS&S Division, Kadapa, stating

that the bills due for the petitioner belong to the current year 2017-18 and that they are under preparation for making payment. In those circumstances, and since the term of the petitioner has drawn to a close, the Writ Petition is closed with the observation that the bills shall be settled in favour of the petitioner as expeditiously as possible. No costs.

Consequently, the miscellaneous Applications, if any stand closed.
