THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.31232 OF 2012 ORDER:

The grievance precisely in the present Writ Petition is the non-disclosure of the particulars of the alleged crime and the alleged rowdy sheet opened against the petitioner and the petitioner herein is also consequently asking for a direction to the 1st respondent to disclose the particulars of the same. 2.

Heard Sri C.Nageswara Rao, learned counsel, appearing for the petitioner and learned Government Pleader for Home, appearing for the respondents.

A counter affidavit deposed by Sub Inspector of Police, Gudivada Taluk Police Station, Krishna District - 1st respondent herein is filed, inter alia, stating that to curb and curtail the unlawful activities of the petitioner herein in the vicinity of Gudivada Taluk Police Station more particularly in conducting gambling, proposals were submitted to the Sub Divisional Police Officer, Gudivada Division, Krishna District on 26.06.2012. The said counter further states that after careful perusal of the record, the Sub Divisional Police Officer, Gudivada Division, accorded permission to open rowdy sheet against the petitioner herein vide Proceedings C.No.150/SDO-G/2012, dated 10.07.2012 and accordingly, a rowdy sheet was opened against the

AVSS,J W.P.31232 of 2012 petitioner herein on the rolls of Gudivada Taluk Police Station, Krishna District on 10.07.2012 and the same is being continued and renewed from time to time. 4.

While referring to the averments, it is stated by the learned counsel appearing for the petitioner that the very opening of the rowdy sheet is unsustainable and contrary to law.

The said contention, in the considered opinion of this Court, cannot be considered in the present writ petition and it is obviously beyond the scope of the writ petition as the 1st respondent herein already furnished the necessary details with regard to opening of rowdy sheet against the petitioner as sought in this writ petition.

For the aforesaid reasons, Writ Petition is dismissed, with a liberty to the petitioner to assail the opening of rowdy sheet against him, if he is so advised.

Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
