This writ petition is filed under Article 226 of the Constitution of India, for the following relief:

"To issue a writ, order or direction more particularly one in the nature of a writ of Mandamus declaring the action of the respondents 4 and 5 in interfering with petitioners right to dig the tanks in an extent of Ac.32.50 cents in Sy.No.369/3A-3B of Ogirala Village, Bapulapadu Mandal, Krishna District, AP on the basis of the permission granted by the 2nd respondent on 27-02-2017 as highly illegal, arbitrary, contrary to law and unconstitutional and consequently direct the respondents not to interfere with the digging work in the said land."

When the matter is called, the learned Government Pleader for Fisheries has placed on record the instructions received from the office of the Deputy Director of Fisheries, Krishna, Machilipatnam stating that the District Collector and Chairman DLC has issued orders cancelling Provisional permission vide Procs.No.1764/A3/2015, dated 03.03.2017 and in fact a copy of the cancellation orders issued by the District Collector is also placed on record.

In vies of the above, Writ Petition is closed with a liberty to the petitioner herein to assail the said order of cancellation before the appropriate forum, if he is advised to do so. As a sequel, miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date:20.03.2017 grk
