Barla Devaraju, v. Superintendent Of Police, Karimnagar,
THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.34823 of 2014 ORDER:
Heard the learned counsel for the petitioner as the learned Government Pleader for respondents 1 to 3.
2.
The prayer sought in the writ petition is as under: 'For the reasons stated in the accompanying affidavit it is prayed that, the Honourable Court may be pleased to issue an order or direction or a writ more particularly one in nature of a writ of mandamus by declaring the inaction of respondents in not investigating the case and not arresting the accused pursuant to the FIR in Cr.No.105 of 2014 of P.S. Ellanthakunta, dated 01-102014 even after lapse of one and half month is illegal, arbitrary, unreasonable as it is violation of Article 14 & 21 of the constitution of India and consequently direct the respondent No.2 to investigate into the complaint and take action as per law and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case, in the interest of justice.' 3.
The learned Government Pleader brought to the notice of this Court that pursuant to registration of Cr.No.105 of 2014, investigation was completed and a charge sheet was filed before the Judicial Magistrate of First Class, Siricilla, and after committal, the matter was placed before the V Additional District Judge. The same was taken on file as S.C.No.9 of 2018, which is pending trial.
4.
In that view of the matter, no further cause would survive in the writ petition, since the charge sheet has already been filed and the committal proceedings were passed and that the case is made over to the V Additional Sessions Judge, vide S.C.No.9 of 2018. Therefore, the writ petition is liable to be closed.
5.
Accordingly, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTI CE P.KESHAVA RAO Date:09.01.2020 PGS
