THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 39889 of 2012 ORDER :
Petitioner prays for the following relief:
"to issue any appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent in not allotting the additional load of power supply of 63 KW to the petitioner's Plot bearing No.317 of Sri Swamy Ayyappa Cooperative Housing Society Limited in Sy.No.11/14 to 11/18 of Khanapur Village, Madhapur, Hyderabad as illegal, arbitrary and violative of principles of natural justice and violative of Articles 14 of the Constitution of India and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard the learned counsel for petitioner and standing counsel for APCPDCL appearing for respondent. From the material available on record, it appears, on 07.11.2012 the petitioner applied for sanction of additional load of power supply of 63 KV to his plot No.317 of Sri Swamy Ayyappa Co-operative Housing Society Limited. Admittedly, as on date, the representation remains unattended for more than one reason. As the grievance in the writ petition is against inaction, I am satisfied that the
writ petition can be disposed of with a direction to the respondent to dispose of the representation.
Accordingly, the Writ Petition is disposed of giving liberty to the petitioner to communicate a copy of this order together with the representation dated 07.11.2012 to the respondent within four (4) weeks from today and the respondent is directed to consider and pass appropriate orders on the representation within eight (8) weeks from the date of receipt of the representation. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. ____________________ JUSTICE S.V.
