HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.34848 OF 2014 O R D E R:

The petitioner claims to have purchased an extent of Ac.101 cents in Sy.No.100/1 situated at Dugganapalli Village, Chennur Mandal, Y.S.R. District under a Registered Sale Deed bearing Document No.6487/2013, dated 17.09.2011 for a valuable consideration. Thereafter, the petitioner approached the 4th respondent and filed an application in Form VI A under Section 4 (1) read with Rule 18 of Rights in Land & Pattadar Pass Book Act, 1971 (in short "the Act").

The grievance of the petitioner is that in spite of his application having been filed on 01.09.2014, the same has not been disposed of and the same was rejected with an endorsement dated 08.09.2014 stating that in relation to the R.S.R. there is a Court case pending, as such it is not possible to issue pattadar passbook. It is also stated that the pattadar column contains dots (....).

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

A perusal of the endorsement does not disclose, what is the case that is pending, and there is no mention of any rival claims with respect to the said property etc. In that view of the matter, the endorsement is totally meaningless, and the 3rd respondent has not given the particulars to the petitioner about the exact reason why the mutation sought for and issuance of pattadar passbook been rejected. In that view of the matter, I

deem it appropriate to set aside the endorsement with a direction to the 4th respondent to communicate to the petitioner the exact nature of objections for mutating their name in revenue records and for issuance of pattadar passbook in his name. On such furnishing of details, petitioner is at liberty to take appropriate steps as may be advised.

With the above direction, the Writ Petition is disposed of at the admission stage. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, shall stand closed.
