HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA C.R.P. Nos.2946 & 3011 of 2017 COMMON ORDER:

C.R.P.No.2946 of 2017 is filed seeking to set aside the docket order dated 06.04.2017, passed in I.A.No.574 of 2017 in O.S.No.915 of 2009 on the file of the learned IX Additional Senior Civil Judge, Rangareddy District at L.B.Nagar, by reopening the plaintiffs side, whereas, C.R.P.No.3011 of 2017 is filed seeking to set aside the docket order dated 06.04.2017 passed in I.A.No.576 of 2017 in O.S.No.915 of 2009 and permit to cross examine PW1.

2. Heard the learned counsel for both sides.

3. Both the Civil Revision Petitions are allowed for the reason that the learned counsel for the respondents has not opposed. However, he requests to fix a date for cross-examination of PW1. This Court cannot fix a date since the convenience of the Court below is to be decided by the Court below itself. Therefore, on the date which the Court below would fix, the revision petitioners herein shall positively cross-examine PW1 and complete cross-examination of PW1 on that day itself. Keeping in view, that the suit relates to the year 2009, it is desirable to direct the learned IX Additional Senior Civil Judge, Rangareddy District at L.B.Nagar to dispose of the suit itself as expeditiously as possible not later than six (6) months from the date of receipt of a copy of this order. No order as to costs.

ASN, J C.R.P.Nos.2946 & 3011 of 2017 As a sequel thereto, Miscellaneous Petitions, if any, pending in these Civil Revision Petitions stand closed.
