THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6285 of 2018 O R D E R :

This Writ Petition is filed to declare the action of the 2nd respondent Revenue Divisional Officer, Atmakur, SPSR Nellore District, in continuing the authorization of the petitioner in respect of fair price shop No. 22, Basinenipally Village, Seetharamapuram Mandal, SPSR Nellore District under prolonged suspension and further calling for applications for the appointment of a dealer to the said shop, as illegal and arbitrary.

The case of the petitioner is that his fair price shop licence came to be suspended on 02.12.2016. It is his specific grievance that though a show cause notice was issued, neither any inquiry was conducted nor proceedings were initiated. When the matter is taken up, today, for admission, learned Government Pleader for Civil Supplies (Andhra Pradesh) has produced before this Court a copy of the order dated 09.06.2017 said to have been passed by the 2nd respondent and the same is taken on record.

A perusal of the said order shows that it was passed in June 2017 cancelling the authorisation of the petitioner fair price shop dealer. Therefore, the allegation in the Writ Petition that there is no order passed after suspending the authorisation would not stand any further. Inasmuch as, now, the order has been made, no further relief in the Writ Petition can be granted. However, it is left open for the petitioner to challenge the order dated 09.06.2017, in accordance with law.

The Writ Petition is therefore, closed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
