THE HONOURABLE SRI JUSTICE T. AMARNATH GOUD I.A.No.2 of 2019 In/and CRIMINAL PETITION No. 1921 of 2019 ORDER:
1) The petitioners, who are accused Nos.1 to 4, 6 and 7, filed this Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of investigation in Crime No.120 of 2019 of Begumpet Police Station, Hyderabad, which was registered for the offences punishable under Sections 120-B, 467, 468, 471 and 420 read with 34 IPC, basing on the complaint made by the second respondent.
2) During pendency of the Criminal Petition, I.A.No.2 of 2019 came to be filed to record the compromise. The affidavit of the second respondent filed along with the said petition would disclose that at the intervention of elders and well wishers, the parties have settled their disputes.
3) Today, the parties are present before this Court and they also filed their proof of identification. When examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioners. The affidavit of the second respondent also indicates the same.
4) Taking into consideration the settlement arrived at between the parties and since the second respondent is not interested to prosecute the case against the petitioners, continuation of investigation against the petitioners would amount to an abuse of process of law.
5) Accordingly, I.A.No.2 of 2019 is ordered. Consequently, the Criminal Petition is allowed and the investigation against the petitioners in Crime No.120 of 2019 of Begumpet Police Station, Hyderabad, is hereby quashed. Miscellaneous petitions, if any, shall stand closed.
