This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.2 to 4 in Crime No.142 of 2026 on the file of Balanagar Police Station, Division:

Balanagar-Cyberabad, registered for the offence punishable under Section 80 read with 3 (5) of the BNS and Section 3 (2) (v) of the SCs/STs (POA) Amendment Act, 2015.

Heard Sri B.Muralidhar, learned counsel for the petitioners-accused Nos.2 to 4 and Sri M.Ramachandra Reddy,

learned Additional Public Prosecutor appearing for the respondent-State.

Notice served on the victim.

The case of the prosecution is that the de facto complainant lodged a report before police on 26.02.2026, wherein it is stated that the victim and Accused No.1 are wife and husband. During their lawful wedlock, they were blessed with four children. The victim and A.1 are residing in Hyderabad. It is stated that since the marriage the A.1 harassed the victim both physically and mentally and also used to beat her and demanding to get money for purchasing auto and house. It is also stated that on 26.02.2026 the complainant received phone call that the victim committed suicide. It is stated that A.2 to A.4 also harassed the victim. As such, he requested the police to take necessary action against the accused persons. Basing on the same, police registered a case for the aforesaid offences.

Learned counsel for the petitioners-accused Nos.2 to 4 would submit the petitioners are no way connected the with the said offence and they are not residing with the victim and accused No.1 and there is no averments in the complaint to show that the petitioners and victim are residing together and

they harassed the victim; that the petitioners have been falsely implicated in this case; that A.1 is arrested and remanded to judicial custody; that as material of the part of the investigation is completed, custodial interrogation of the petitioners is not required and hence, he prays to grant Anticipatory bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the allegations levelled against the petitioners clearly show that these petitioners harassed the victim for additional dowry, at this stage, the petitioners are not entitled for grant of bail and hence, he prays to dismiss the petition.

Having regard to the submissions made by both the parties and on perusal of the material placed on record, the evidence of L.Ws.1 to 8 were already examined and material part of the investigation completed, this Court is inclined to grant bail to the petitioners subject to the following conditions: (i) The petitioners-accused Nos.2 to 4 shall surrender before the Station House Officer, Balanagar Police Station, Cyberabad District, within two (2) weeks from today, and on such surrender, the petitioners shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each.

(ii) On such release, the petitioners shall appear before the concerned Investigating Officer on every Wednesday between

09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

(iii) The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
