HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.1958 of 2022 O R D E R:

This Criminal Petition under Sections 437 and 439 Cr.P.C. is filed by petitioner - Accused No.3 in Cr.No.03 of 2022 on the file of Thipparthy Police Station, Nalgonda District, registered for the offences punishable under Section 304-B IPC and under Sections 3 and 4 of Dowry Prohibition Act, seeking bail. 2.

The case of prosecution is that the de-facto complainant has lodged a complaint stating that the marriage of his younger daughter, by name, Renuka, was performed with A1 in the year 2018 and thereafter, A1, at the instigation of the other accused, has harassed his daughter mentally and physically by demanding additional dowry. That on 02.01.2022, all the accused have picked up a quarrel with his daughter, abused her in filthy language and abetted her to commit suicide and at about 12.00 noon, his daughter has committed suicide by hanging from a ceiling fan.

Learned counsel for petitioner Mr. K. Sita Ram, submits that petitioner is alleged to have committed the offences under Section 304-B IPC and under Sections 3 and 4 of Dowry Prohibition Act. He submits that the petitioner was arrested and remanded to judicial custody on 08.01.2022 and from the last 58 days, she is

languishing in jail. Learned counsel submits that the petitioner is unconnected with the family affairs of the deceased and A1 and just because she is a family member of A1, she has been implicated in this case. Learned counsel submits that only bald allegations were made against the petitioner with an intention to implicate her in this case and as she is languishing in jail since 58 days, her case may be considered for grant of bail.

On the other hand, learned Assistant Public Prosecutor submits that the investigation is pending and so far, 10 witnesses were examined. He submits that there are specific overt acts against the petitioner stating that she has harassed the deceased by demanding registration of the land on her name and not able to bare such harassment, the deceased has committed suicide. He submits that the investigation is pending and at this stage, petitioner is not entitled for bail.

Taking into consideration the fact that the petitioner/A3 is languishing in jail since 08.01.2022 and as it is stated that the petitioner is the sister-in-law of A1 and staying away from the family of A1 and in view of the matrimonial disputes, this Court deems it appropriate to grant bail to the petitioner-A3.

The Criminal Petition is allowed. Petitioner - Accused No.3 shall be enlarged on bail in connection with Crime No.03 of 2022

of Thipparthy Police Station, Nalgonda District, on her executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the Special Sessions Judge for Trial of Cases Relating to Atrocities Against Women-cum-IX Additional District and Sessions Judge, Nalgonda. _______________________ LALITHA KANNEGANTI, J 7th March, 2022.
