HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.36296 of 2016 ORDER:

Petitioner filed this writ petition alleging that his applications dated 22.12.2015 and 08.02.2016 for renewal of Prospecting License in respect of land admeasuring Ac.10.00 in Sy.No.76 of Chedurpally Village, Veldanda Mandla, Nagarkurnool District and application dated 21.04.2016 for grant of mining lease in respect of the said land is not acted upon so far.

Petitioner alleges that so far no action is taken on the applications submitted for renewal of Prospecting License and for grant of mining lease and petitioner is left in the lurch after 25.12.2015 when the earlier license period expired and for no valid reason, the said applications are not processed. 3.

Learned counsel for petitioner apprehends that applications of the petitioners are not processed, whereas the 2nd respondent is making attempts to consider the application of 5th respondent for grant of mining lease, ignoring the applications of the petitioners. 4.

Learned Government Pleader submits that orders would be passed on the applications submitted by the petitioners within a period of six weeks.

The applications of the petitioner are admittedly pending for consideration. At this stage, no opinion can be expressed on the rival claims of the petitioner as well as 5th respondent and competence of the authority to consider the application of 5th respondent. The Court can only direct expeditious consideration of

the applications submitted by the petitioner without expressing any opinion on merits.

Having regard to the same, writ petition is disposed of, directing the Director of Mines & Geology (2nd respondent) to consider the applications submitted by the petitioners on 22.12.2015 and 08.02.2016 for renewal of Prospecting License and on 21.04.2016 for grant of mining lease as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
