THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6313 of 2018 ORDER:
The petitioner states that he is the absolute owner and possessor of the land in Survey No.569/D in an extent of Acs.3.50 cents situated at Phirangipuram Village and Mandal, Guntur District. The said land was acquired by his ancestors in the year 1963 through registered sale deed dated 11.04.1963. After partition among brothers and sisters, an extent of Ac.1.11 cents fell to the petitioner's share. In the pahani for the year 2016, the name of the petitioner's father was recorded as pattadar in column No.12 and possessor in column No.13. But, in column Nos.16 and 17, it was recorded as inam land. When the petitioner wanted to sell his share of land, registration was refused on the said ground. The petitioner, therefore, submitted an application on 31.08.2016 to the third respondent seeking rectification.
The same was forwarded to the fourth respondent for taking necessary steps as per the guidelines and instructions duly examining the registration documents and ownership. In spite of repeated requests, when there was no action from the fourth respondent, the present Writ Petition is filed.
This Court noticed that the petitioner did not apply in proper proforma for mutation of his name in the revenue records and in view of the same, liberty is given to the petitioner to apply for mutation of his name in the prescribed proforma
under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act. As and when such application is filed, it is needless to observe that the fourth respondent shall pass appropriate orders in accordance with law after issuing notice to the parties interested in the said property.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 26.02.2018 vs
