Heard Sri P.V.S.S.S. Rama Rao, learned counsel for the petitioners and the Government Pleader for Education appearing for the respondent.

The petitioners-Educational Institutions have filed this Writ Petition challenging the Memo bearing No.12080/COSE/A2/2004-4, dated 20.10.2004 issued by the respondent-State Government.

Both the learned counsel agree that the said Memo has been declared as illegal in a batch of cases in W.P.No.9503 of 2005 and batch, dt.30.07.2013 and the instant case is squarely covered. 4.

Hence, following the order and for the reasons alike, this Writ Petition is disposed of and the Memo is declared as illegal. Consequently, the respondent is directed to accord permission to the petitioners-Institutions to fill up vacant grant-in-aid posts in accordance with the Rules. The whole exercise of according permission to the petitioners-institutions on the part of the respondent-authority shall be completed expeditiously at any rate within three months from the date of receipt of a copy of this order. No order as to costs.

Consequently, miscellaneous petitions pending if any, shall stand dismissed.
