HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29339 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed challenging the order of the 4th respondent vide Lr.No.A/13/2015, dated 12.06.2017, wherein the application filed by the petitioner for appointment to the post of Village Revenue Assistant on compassionate grounds, was rejected on the objections raised by the Villagers of Yellapuram Village.

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

Learned counsel for the petitioner submits that before passing the impugned order, no notice was issued to the petitioner enabling her to file documents; that the petitioner also filed Photostat copies of Aadhar card, ration card and other documents to show that she is a resident of Yellapuram Village and hence, he prays to set aside the impugned order.

A reading of the impugned order would go to show that objections were called for from the villagers of Yellapuram village, thereafter, the respondents passed the impugned order rejecting the request of the petitioner without giving opportunity to her to file documents in support of her case basing on the objections of the villagers only.

In view of the above and considering the facts and circumstances of the case, the impugned order, dated 12.06.2017, is set aside and the 4th respondent is directed to consider the application of the petitioner afresh for appointment as Village Revenue Assistant on compassionate

grounds, after giving opportunity to the petitioner to file necessary documents.

The Writ Petition is allowed to the extent indicated above. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
