THE COURT MADE THE FOLLOWING:

ORDER:

The grievance of the petitioners is that despite their approaching respondent No.3 in the first instance and respondent No.2 later, neither of the respondents has taken any steps for mutation of their names in the panchayat records relating to property bearing No.3-55 of Janwada Village and Gram Panchayat, Shankerpally Mandal, Ranga Reddy District.

A perusal of the record shows that the petitioners have not made any application to respondent No.3, who is the competent authority to effect mutation, though they have made a representation to respondent No.2. In my opinion, unless an application under the provisions of the Andhra Pradesh Panchayat Raj Act, 1994 and the Rules made thereunder is made to respondent No.3, the petitioners cannot feel aggrieved by the purported inaction of the said respondent. In this view of the matter, the petitioners are permitted to make an application to respondent No.3 for mutation. Within two months from the date of receipt of such application, respondent No.3 shall hold an enquiry in accordance with the prescribed procedure, take a decision and communicate the same to the petitioners.

The writ petition is accordingly disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.42649 of 2015 shall stand disposed of as infructuous.
