THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22146 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the fourth respondent in threatening the petitioners and their family members while construction of house at plot No.80 in survey No.196 part admeasuring 88 Sq. Yards situated at Jai Jawahar Nagar Colony, Yapral Village, as illegal and arbitrary. Heard the learned counsel for the petitioners and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to R-5.

The case of the petitioners is that they are the absolute owners and possessors of the land in plot bearing Nos.80 and 81 in survey No.196 part admeasuring 176 Sq.Yards situated at Jai Jawahar Nagar Colony, Yapral Village, Ranga Reddy, having purchased the same from one M.Dorai under a registered sale deed No.3122 of 2006 dated 13.06.2016. Out of said land, petitioners sold 88 Sq.yards of land in plot No.80 in survey No.196 part to one Pravash Chandra Panda under registered sale deed dated 08.04.2013. The grievance of the petitioners is that when said Pravash Chandra Panda started construction in the land purchased by him from the petitioners, the respondents-Police are interfering with the construction work by calling the petitioners and said Pravash Chandra Panda, at the instance of R-5 herein.

The learned AGP, on instructions, denies the allegations made in the affidavit filed in support of the writ petition and submits that the respondents-Police never interfered with the civil disputes, which are pending between the parties. Recording the said submission, the Writ Petition is disposed of, directing the respondents-Police not to interfere with the civil disputes, which are pending between the parties in respect of construction work being undertaken at plot No.80 in survey No.196 part admeasuring 88 Sq. Yards situated at Jai Jawahar Nagar Colony, Yapral Village, Ranga Reddy. However, if the respondents-Police intend to take any action against the petitioners, they shall follow the procedure established under law. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
