THE HON'BLE SRI JUSTI CE A. RAJASHEKER REDDY W RI T PETI TI ON No.2 9 1 9 2 of 2 0 1 7 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner questioning the Proceedings No.A1/ 3435/ 2017, dt.10.07.2017 issued by the respondent No.2, wherein the petitioner was suspended pending disciplinary proceedings.

Sri Challa Dhanamjaya, learned counsel for the petitioner, submits that initially the petitioner was transferred by Proceedings dt. 06.07.2017 and when he reported to District Collector in pursuance of the Transfer Orders, the petitioner was served with the impugned Order of suspension and that in the transfer proceedings, there is no whisper about the allegations mentioned in the suspension order.

Learned Government Pleader appearing for the respondents submits that the petitioner working as a Tahsildar was not implementing the Government schemes, as such the order of suspension pending enquiry was issued. Merely because there is no whisper about the allegations in the transfer order, dated 06.07.2017, it cannot be said that the respondents cannot invoke the power of suspension pending enquiry.

Since allegations are made, the truth or otherwise of allegations cannot be gone into at this stage. Hence, this Court

is not inclined to interfere with the impugned Order. However, the respondents are directed to conduct an enquiry within a period of four weeks from the date of receipt of a copy of this Order.

With the above direction, this Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
