HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.519 of 2019 ORDER:
This Contempt Case is filed alleging willful disobedience of the order dated 11.12.2018 passed by this Court in Writ Petition No.44772 of 2018.
Counter-affidavit is filed by the respondent, wherein it is inter alia stated as under:
"I respectfully submit that as per the schedule, the Mandal Surveyor who visited the field in sy.No.452 and 453 situated at Kanagarthi Village on 08.01.2019 and submitted a report dated 09.01.2019 as per the records and as well as the report, the petitioner is having Acs.1.17 guntas of land in Sy.No.452 and an extent of Ac.0.06 guntas of land in Sy.No.453 situated at Kanagarthi Village, but the petitioner has not attended the survey work on 08.01.2019 as scheduled and the remaining pattadars of the land in Sy.Nos.452 and 453 were present and they have made objection for the survey and demarcation stating that there is a dispute prevailing between them and therefore, the survey and fixation of boundaries of the land relating to the petitioner could not be done. Accordingly, a memo was issued to the petitioner vide Memo No.
B/85/2019 dated 30.01.2019, but the petitioner was not available at Kanagarthi Village, copy of the memo was affixed at the doorstep of the house of the petitioner in presence of the witnesses on 31.01.2019. The copy of the same is enclosed herewith for kind perusal of this Hon'ble Court. The present Contempt Case is field by the petitioner suppressing the facts and invented the allegations against the respondent to maintain the Contempt Case and the same is liable to be dismissed."
Today, though the Contempt Case is listed under the caption 'for dismissal', there is no representation for the petitioner. Even no reply-affidavit is filed by the petitioner contradicting the averments in the counter-affidavit.
In view of the same, this Court does not find any contempt being committed by the respondent.
