THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No.29900 OF 2013 ORDER:

Challenging the order, dated 23.08.2013, passed by the Commissioner, Greater Hyderabad Municipal Corporation (GHMC), rejecting the request of the petitioner for consideration of his case for appointment on compassionate grounds consequent upon the death of his father in harness while in service of GHMC, this Writ Petition is instituted.

GHMC is a local body. Any service dispute between its employees is got to be first of all placed before the Administrative Tribunal constituted under the Administrative Tribunals Act, 1985, as declared by the Supreme Court in L. Chandra Kumar v. Union of India[1]. Hence, the Writ Petition deserves to be dismissed preserving liberty to the petitioner to approach the competent forum. Accordingly, the Writ Petition is dismissed. The Registry is directed to return the original impugned order to the petitioner to enable him to present the same before the appropriate forum duly keeping a copy thereof on record. There shall be no order as to costs. Consequently, the miscellaneous petitions, if any, shall also stand disposed of.
