THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6271 of 2018 ORDER:

The petitioners state that they are the owners and possessors of land admeasuring Acs.32.17 guntas in Survey Nos.216 to 219 situated at Maheswaram Village and Mandal, Ranga Reddy District. They state that the said land was acquired under registered sale deeds Nos.2283/2001 and 594/2002 from the office of the Sub Registrar, Maheswaram. Their names were mutated in the revenue records and pattadar pass books and title deeds were issued. Their vendor also purchased the said land under registered sale deeds. The land was involved in agricultural land ceiling proceedings and it was declared as non-surplus land. However, the land was included in the prohibited properties list under Section 22-A of the Registration Act on the ground that it is a land ceiling surplus land. The same was challenged by the petitioners in W.P.No.

39037 of 2017 and the same is pending. When a notice was issued by the fourth respondent on 20.12.2017 under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 1977, the petitioners filed detailed objections on 19.01.2018. The present Writ Petition is filed apprehending dispossession even before passing an order.

Since the petitioners state that the proceedings pursuant to the notice issued on 20.12.2017 are pending before the fourth respondent, the fourth respondent is directed to consider

the objections filed by the petitioners on 19.01.2018 and pass appropriate orders thereon in accordance with law. Till such orders are passed, the possession of the petitioners shall not be interfered.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 26.02.2018 vs
