THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.21913 of 2006 Order: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) In this writ petition, the validity of G.O. Ms. No. 201 dated 16.5.2006 is under challenge. Earlier, by G.O. Ms. No. 855 dated 7.10.2005, the areas covered under the erstwhile Rajam Gram Panchayat of Srikakulam District were declared as a transitional area, and the Rajam Nagar Panchayat was deemed to have been constituted. By G.O. Ms. No.201 dated 16.5.2006 the Government, after careful consideration, decided to reconstitute the Rajam Mandal Parishad, excluding six Mandals which became a part of the Rajam Nagar Panchayat in terms of G.O. Ms. No.855 dated 7.10.2005.

A Division Bench of this Court, by its order in W.P. No. 23727 of 2005 and batch dated 25.11.2015, set aside G.O. Ms. No.855 dated 7.10.2005 granting liberty to the Government to reconsider the issue, take a fresh decision and issue a Government order in accordance with law. The earlier interim order was directed to remain operative till a decision was taken afresh. As G.O. Ms. No. 201 dated 16.5.2006, impugned in this writ petition, was passed as a consequence of G.O. Ms. No.855, dated 7.10.2005, which has already been set aside, the consequential G.O. Ms. No.201 dated 16.5.2006 must also be, and is accordingly, set aside.

By order of this Court in W.P.M.P. No. 27796 of 2006 dated 30.10.2006, status-quo was directed to be maintained. The respondents shall reconsider the issue, take a fresh

decision and issue a G.O. in accordance with law. Till a decision is taken afresh, the earlier order of status-quo shall continue to remain in force.

The writ petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall also stand disposed of.
