ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner No.2, who is arrayed as accused No.2 in Crime No.19 of 2026 before the Dudyal Police Station, Vikarabad

District, registered for the offences punishable under Sections 109, 118 (1), 352 read with 3(5) of BNS.

The brief facts of the case are that the de facto complainant, on 28.02.2026, lodged a complaint before the police stating that on the same day at about 16:00 hours, her parents were picking tamarind fruits from a tree. In the meantime, their relatives, due to previous land disputes between the two families, came there and beat her father with a stick, as a result of which he sustained blunt injuries on his back. Thereafter, one Bhimla Naik and his grandson Vishal beat the complainant's mother with sticks, causing a bleeding injury on her right hand and multiple blunt injuries on her body. When the complainant questioned the same, the accused Rathod Raju came with an axe and hit her on the back of her head, resulting in a bleeding injury, and attempted to kill the complainant and her family members.

Subsequently, the accused persons abused the complainant and her family members in filthy language. Hence, the complainant requested the police to take necessary action against the accused persons, and based on the said complaint, a case was registered under the relevant sections, wherein petitioner No.2 was arrayed as Accused No.2.

Heard Sri R.Prashanth, learned counsel appearing on behalf of the petitioner as well as Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petition insofar petitioners as it relates to Nos.3 to 7/Accused Nos.3 to 7 has become infructuous and the petition against petitioner No.1/Accused No.1 is dismissed as withdrawn. It is further contended that petitioner No.2/Accused No.2 is innocent of the alleged offences and has been falsely implicated in the present case and also submits that there are no speciic allegations against the petitioner No.2/Accused No.2, though his name is mentioned in the complaint. It is also submitted that Petitioner No.2 is suffering from health issues and particularly a heart ailment. Therefore, he prayed that this Court grant pre-arrest bail to the petitioner No.2.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the offences alleged are grave and heinous in nature, and that Section 109 is applicable to the

present case. Therefore, he prayed that this Court may be pleased to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that the case against petitioner Nos.3 to 7 (Accused Nos.3 to

7) has become infructuous, and the petition against petitioner No.1 (Accused No.1) is dismissed as withdrawn. Insofar as petitioner No.2 (Accused No.2) is concerned, on consideration of the application in Cr. No.19 of 2026 and the medical report, it appears that there are no specific allegations against petitioner No.2/Accused No.2. Considering the facts of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner No.2 shall surrender before the Station House Officer, Dudyal Police Station, Vikarabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.

ii.

The petitioner No.2 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023

and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner No.2 shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is partly allowed. Miscellaneous applications, if any pending, shall stand closed.
