2. Petitioners claim to purchase the property in Survey No.106/1 to an extent of Ac.0-69
cents out of Ac.1-38 cents situated in Proddutur Village fields at Gopavaram Panchayath, Proddutur Village, Proddutur Mandal, Y.S.R.Kadapa District from M.Gurivireddy, S/o.Late Narayana Reddy. Petitioners' vendor executed an agreement of sale on 21.11.2015 and the same was presented before the 3rd respondent for registration. The 3rd respondent is not even receiving the document for registration. Questioning the same, the present writ petition is filed.
3. The issue in this writ petition is similar to the one considered by this court in W.P.No.17809 of 2015 and batch dated 22.06.2015.
4. Following the same, this writ petition is disposed of directing the registering authorities concerned to receive and process the documents presented by the petitioner without insisting upon no objection certificate. The registering authorities concerned is further directed to receive and process the document in accordance with the Registration Act, 1908 and Indian Stamp Act, 1899 and if the document is in conformity with the provisions, thereafter register and release the documents in accordance with the due procedure. It is also made clear that in the event of registering authority not being satisfied with the compliance under the Registration Act or the Stamp Act, appropriate refusal endorsement together with reasons shall be recorded and communicated to the parties in terms of Section 71 of the Registration Act.
Registry to append a copy of the order in W.P.No.17809 of 2015 dated 22.06.2015 along with this order.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
