Questioning the notification issued by the Revenue Divisional Officer, fourth respondent, vide proceedings No.Ref.A/9801/2006 dated 26.09.2016 with respect to establishing new fair price shops as illegal and arbitrary, the present writ petition is filed. 2.
Learned counsel for the petitioner submits that petitioner has been functioning as an in‐charge dealer of Shop No.61 and that now a notification dated 26.09.2016 has been issued calling for applications appointing Shop No.61 on permanent basis. Learned counsel further submits the petitioner made a representation dated 02.07.2014 for allotment of Shop No.61 in his favour on permanent basis but till date the same has not yet been considered.

Though there is no right to the petitioner seeking allotment of Shop No.61, as admittedly he is only officiating the duties as incharge dealer on account of the resignation of the existing dealer, without expressing any opinion on the merits or demerits of the matter, there shall be a direction to the respondents to consider the representation of the petitioner dated 02.07.2014 and communicate the decision to the petitioner within a period of eight weeks from the date of receipt of a copy of this order.
With the above direction, the Writ Petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
