HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.15712 of 2017 Order:

This Writ Petition is filed challenging the registration of FIR No.21 of 2017 by the third respondent pursuant to reference of the complaint of the fourth respondent to the police by the learned Magistrate. This Court carefully perused the order passed by the learned Magistrate and it disclosed the application of mind by the learned Magistrate. In such a situation, this Court is not inclined to hold that the registration of complaint is bad in law. It is for the third respondent to continue the investigation by duly following the procedure under law including compliance with Section 41-A of the Code of Criminal Procedure. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
