THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.1326 of 2016 ORDER:
Petitioner states that his appeal No.E6/4362/2013 is pending with the second respondent since 01.10.2013 and that the second respondent has already called for report but no date of hearing is fixed as yet. Seeking early disposal of the said appeal, the present Writ Petition is filed.
It is noticed from the grounds of appeal that private party respondent is also figured in the said appeal but whether notice given is served or not is not clear.
In the circumstances, the second respondent is directed to fix an early date for hearing of the appeal and if service on the private party respondent is complete, then the second respondent shall hear the parties and decide the appeal expeditiously, preferably, within three months from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
