THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6317 of 2018 O R D E R :

The petitioner challenges, in this Writ Petition, the Award dated 16.10.2017 passed by the 2nd respondent Arbitrator rejecting his claim and allowing the counter-claim of the 1st respondent in respect of the dealership of the retail outlet of Vasavi Filling Station at Regupalem Village, Yellamanchili, Visakhapatnam District. Though learned counsel for the petitioner tries to persuade this Court to entertain this Writ Petition, considering the fact that the Award has been made under the provisions of the Arbitration & Conciliation Act, 1996 and also considering the fact that Section 34 thereof provides for an effective alternative remedy for challenging an arbitration award, this Court is not inclined to entertain the Writ Petition.

Since the petitioner received a copy of the Award dated 16.10.2017 on 08.11.2017 only, liberty is given to him to approach the competent Court challenging the Award invoking Section 34 of the 1996 Act which shall be considered in accordance with law. Subject to the above, the Writ Petition is closed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
