Petitioner And The State of Telangana, Rep., by its Principal Secretary, Revenue Department, Secretariat Building, Hyderabad & others.
.. Respondents This court made the following :
- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.7649 OF 2019 ORDER :
Heard learned counsel for petitioner and learned Government pleader for Revenue for respondents 1 to 4. 2.
Petitioner is aggrieved by correction of name in the revenue records reflecting the name of 5th respondent on land to an extent of Ac.0-08 guntas in Sy.No.496/E, of Ramancha Village, Chinnakodur Mandal, Siddipet District. The material on record discloses that a notice was issued on the application filed by 5th respondent for mutation of her name and after the objections filed by petitioner the name of 5th respondent was mutated.
After the mutation, petitioner again made representation to the Tahsildar, to delete the name of 5th respondent and to include her name. However, as can be seen from the provisions of Telangana State Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act, 1971'), once a decision is made by the Tahsildar, he has no power to undertake review, except in the case of clerical error in pass books. Petitioner has remedy of appeal under section 5 (5) of the Act, 1971. Without availing such remedy, this writ petition is filed. 3.
Since there is no power of review of order and what is requested by the petitioner would be amounting to review of the decision earlier made, no relief as sought for can be granted.
- 3 - 4.
Thus, leaving it open to the petitioner to avail the remedy of appeal, if so advised, the Writ Petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 10th April, 2019 Rds
