THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.1672 OF 2013 ORDER:
This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in C.C.No.564 of 2012 on the file of V Additional Judicial Magistrate of First Class, Nellore District, for the offences punishable under Section 498(A) r/w 34 I.P.C & Sections 3 & 4 of Dowry Prohibition Act.
The petitioners herein/ Accused 2 to 7 are in-laws and relatives of the second respondent/defacto complainant. The main ground urged by the learned counsel for the petitioners is that they are no way concerned with the alleged harassment of the of the second respondent/defacto complainant by the petitioners herein and submitted that the complaint is bereft of any allegations to attract the offences punishable under Section 498(A) r/w 34 I.P.C & Sections 3 & 4 of Dowry Prohibition Act.
During hearing, learned counsel for the petitioners fairly conceded that the trial has commenced and requested to dispose of the criminal petition without touching the merits of the case. Therefore, recording the submission of the learned counsel for the petitioners, this criminal petitions is disposed of, permitting the petitioner to raise all the contentions before the Trial Court, during trial, if any.
MSM,J Crl.PNo.1672 of 2013 With the above observation, criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Petition shall stand closed. No costs.
