Valaparla Nageshwar Rao v. State Of Ap.,
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2347 OF 2018 ORDER:
This Criminal Petition is filed by the petitioners/accused Nos.2 to 4 and 6 seeking for relaxation of the condition, which was imposed while granting bail to them in Crl.M.P. No.182 of 2018 in Crime No.40 of 2018, by the I Additional Sessions Judge, Guntur on 15.02.2018; the condition being that the petitioners have to execute personal bond for a sum of Rs.50,000/- with two sureties for the like sum each.
2.
Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.
Learned counsel for the petitioners now submits that the petitioners are not in a position to furnish the sureties and, hence, sought for reduction of the surety amount.
4.
Hence, considering the above, this Court is inclined to relax the condition. Accordingly, this Criminal Petition is allowed modifying the condition by directing the petitioners/accused Nos.2 to 4 and 6 to execute personal bond for Rs.30,000/- with two sureties each for the like sum, instead of Rs.50,000/-, as ordered by the Court below. Further, the condition of directing the petitioners/accused Nos.2 to 4 and 6 to surrender before the learned Additional Judicial Magistrate of First Class, Mangalagiri, within 10 days from 15.02.2018 is extended by one month from 15.02.2018. Except the above modifications, the rest of the order dated 15.02.2018 passed in Crl.M.P. No.182 of 2018 shall remain intact.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
