HON'BLE SRI JUSTICE S.V.BHATT W.P.No.36691 OF 2012 ORDER:

The petitioners pray for the following relief: "..to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in proposing the petitioner's land for house Pattas admeasuring Ac. 2.77 in Sy.No.1053-2 in Basinikonda Revenue Village, Madanapalle Revenue Mandal, Chittoor District without any notice as illegal, arbitrary and against of law.." The operative portion of instructions dated 28.11.2012 reads thus: "This respondent will adhere due procedure and follow due process of law while initiating action over the above land and the petition may kindly be dismissed as the same was filed on imaginary grounds."

The Assistant Government Pleader basing on the instructions submits that the respondents will follow procedure stipulated by law either for cancellation of assignment of land or resumption from petitioners.
