HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL REVISION CASE No.626 OF 2018 ORDER:
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
This Criminal Revision Case is disposed of at the admission stage.
Learned counsel for the petitioner would submit that against the judgment of this court in Criminal Appeal No.997 of 2007, the petitioner/A.2 filed Crl.A.No.1527 of 2005 wherein the Honourable apex court passed an order dated 28th April, 2011 to the effect that the petitioner was exempted from surrendering till the next date of hearing of the Special Leave Petition.
The learned counsel for the petitioner would further submit that after passing of the judgment by the High Court convicting the petitioner/A.2, learned Additional Public Prosecutor filed Crl.M.P.No.68 of 2011 on the file of III Additional District Judge, Warangal and court issued N.B.W. against him by its order dated 30th January, 2018. In this background, the learned counsel for the petitioner would submit that the petitioner/A.2 will move an appropriate application either before the III Additional District and Sessions Judge, Warangal for recall of the warrant or the petition before the Honourable apex court seeking suitable orders and with
that liberty, he may be permitted to withdraw the present Criminal Revision Case.
Liberty is granted and the petitioner is permitted to withdraw this Criminal Revision Case.
Accordingly, this Criminal Revision Case is dismissed as withdrawn.
As a sequel, miscellaneous applications pending if any, shall stand closed.
