THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.4848 of 2015 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners-A.2 to A.4 in Cr.No.50 of 2015 of Ulavapadu Police Station registered for the offences punishable under Sections 353 and 506 read with 34 of I.P.C. on the report of the 2nd respondent-defacto-complainant, to quash the proceedings in the said crime.

2. Heard the learned counsel for the petitioners/A.2 to A.4 so also the learned Public Prosecutor representing State-1st respondent before ordering notice to the 2nd respondent/de facto-complainant who is no other than the police constable No.1061 on duty in the above crime and perused the material on record.

3. As the material falls short for this Court to admit the application under Section 482 of Cr.P.C. but for their entitlement to the concession of bail more particularly from the 2nd petitioner is a lady-housewoman, aged about 54 years , the 3rd petitioner is also a lady-housewoman, aged about 80 years, the Criminal Petition is disposed of by giving liberty to the petitioners to surrender before the learned Magistrate concerned and move for regular bail with a notice to the learned Asst. Public Prosecutor concerned, in such an event, learned Magistrate shall grant bail to the petitioners on the same day with necessary condition. Needless to say at post-bail stage their presence before the trial Court can be dispensed with pending investigation.

4.Consequently, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
