Heard.

The petitioner is aggrieved by the action of the 4th respondent in refusing to receive and process the document presented by him for registration and insisting to obtain NOC from the 2nd respondent. The petitioner claims to be an auction purchaser from the 5th respondent Co-operative Society and he is also stated to have been granted Sale Certificate under Form-X by the Deputy Registrar of Co-operative Societies, Anantapur. The petitioner also claims that there is no impediment for registration in view of judgment of the Division Bench of this Court reported in SUB-REGISTRAR, SRI KALAHASTI, CHITTOOR Vs. K.GURAVAIAH AND ANOTHER[1].

Prima facie, the 4th respondent has to examine the Sale Certificate as well as the decision of the Division Bench of this Court, referred to above, and process the document presented by the petitioner for registration in relation to the subject property if satisfied with the compliance under the Stamp Act and Registration Act.
