ORAL ORDER:

Petitioner retired from service on attaining the age of superannuation with effect from 31.3.2011 in the cadre of District Manager. On the ground that disciplinary proceedings are initiated just few days before his retirement, the retirement benefits are not paid to the petitioner. Aggrieved by delay in payment of retirement benefits, this writ petition is filed.

In the counter affidavit filed on behalf of respondent corporation, it is averred that since disciplinary proceedings are initiated against the petitioner, the retirement benefits were earlier not released, however, after due consideration of the entitlement, by proceedings dated 6.1.2012 retirement benefits payable to the petitioner were released and paid. Copy of proceedings dated 6.1.2012 is produced before this Court by learned standing counsel for respondent corporation which would disclose that disciplinary proceedings initiated against the petitioner were dropped vide proceedings dated 13.6.2011 and consequently, amounts payable to petitioner towards gratuity and encashment of earned leave were released.

3. Since the retirement benefits payable to the petitioner were paid vide proceedings dated 6.1.2012, the cause in the writ petition does not survive, therefore the writ petition has become infructuous. Accordingly, the writ petition is dismissed as

infructuous. No costs. However, if the petitioner has any subsisting grievance regarding his claim for retirement benefits and that the amounts which petitioner is entitled to be received are still to be paid, it is open for the petitioner to avail the remedies available to him under the law.
