THE HON'BLE SRI JUSTICE A. V. SESHA SAI WRIT PETITION No.9275 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"...to issue a writ or order or directions more in the nature of Writ of Mandamus declaring the action of the respondents herein in not sending for medical test before the APSRTC Medical officer and appointing petitioner as RTC Constable in the 2nd respondent region as illegal, arbitrary and violation of principles of natural justice and set aside the same and further direct the respondents herein to appoint the petitioner as APSRTC constable by correcting the chest on full inspiration as 89 cms in place of 82 cms and pass such other order or in the circumstances of the case as otherwise the petitioner may suffer irreparable loss and hardship."

2. Heard Sri P. Govinda Rajulu, learned counsel for the petitioner, and Sri A. Rama Rao, learned Standing Counsel for the respondents.

3. When the matter is taken up, it is submitted by the learned counsel for the petitioner that for redressal of his grievance, the petitioner submitted a representation dated 03.02.2016 to the 2nd respondent and no orders have been passed on the said representation. It is however requested by the learned counsel for the petitioner that the 2nd respondent may be directed to pass appropriate orders on the representation within a time frame.

4. The said request is not opposed by the learned Standing Counsel for the respondents.

5. Hence, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter, directing the 2nd respondent to pass appropriate orders on the representation dated 03.02.2016 said to have been submitted by the petitioner within two

months from the date of receipt of a copy of this order as per law. There shall be no order as to costs.

6. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
